Terms of Service

Diese Seite ist noch nicht übersetzt.

Draft, not legally binding. This text is a working draft and must be reviewed and adapted by a lawyer familiar with Czech and EU consumer law before the game launches. Data in square brackets will be filled in by the operator. The draft does not guarantee complete legal protection. If the Czech and English versions differ, the Czech version prevails.

1. Introduction

1.1. These terms govern the use of the website quanteidos.com, the launcher and the online game QUANT EIDOS (together the "Service") and purchases of digital content in the Service.

1.2. The Service is operated by [OPERATOR NAME], company ID [IČO], registered office [ADDRESS], registered in [REGISTER], e-mail [E-MAIL] (the "Operator").

1.3. A user is anyone who creates an account or otherwise uses the Service (a "Player"). If the Player is a consumer, they keep all rights granted by law and nothing in these terms limits them beyond what the law allows.

1.4. The Community rules, the End user licence agreement (EULA), the Privacy policy and the Cookie policy form part of these terms.

1.5. By creating an account, downloading the launcher or making a purchase, the Player confirms they have read and accept these terms.

2. Age and account

2.1. The Service may be used by persons aged 15 or older [VERIFY: the age of digital consent under GDPR art. 8 is 15 in the Czech Republic and may differ in other countries]. Younger persons only with the consent of a parent or guardian, who is responsible for their use of the Service and their purchases.

2.2. Purchases may only be made by adults, or by minors with the consent of a parent or guardian to an extent appropriate to their age.

2.3. The Player provides truthful data, protects their login details and is responsible for everything that happens under their account. Suspected misuse must be reported without undue delay to [E-MAIL].

2.4. An account is personal and non-transferable. Selling, buying, lending or sharing accounts, or playing for others for payment (boosting), is prohibited.

2.5. Pilot and clan names must not be offensive, vulgar, misleading, confusable with the Operator or infringe the rights of others. The Operator may change or block such a name.

3. The Service and its availability

3.1. The Service is provided "as is" and "as available". The Operator does not guarantee uninterrupted, error-free or secure availability, compatibility with every device or the preservation of any particular feature.

3.2. The Operator may temporarily limit or interrupt the Service at any time, in particular for maintenance, updates, security or circumstances beyond its control. It tries to announce planned maintenance in advance.

3.3. The game is online and requires an internet connection and the current version of the launcher and client. Older versions may not be supported.

3.4. Game content evolves. The Operator may at any time change, rebalance, add or remove game content, rules, mechanics, prices, rewards, item and ship statistics, maps and events. Such a change is not a defect of the Service and gives no right to compensation unless the law provides otherwise.

4. Test phases (beta)

4.1. The beta is a test of an unfinished game. It may contain bugs, outages and data loss.

4.2. Progress, accounts, in-game currencies, items and other data from the beta or any other test phase may be partially or fully deleted (wiped) at any time and may not carry over to the full version. The Operator decides on any carry-over and announces it.

4.3. The Player must not publish information marked as confidential (e.g. a closed test) without the Operator's consent.

5. Virtual currencies and virtual items

5.1. The game contains virtual currencies (e.g. Q-Credits, Quantium, Quantum Energy), items, ships, drones, skins, VIP and other virtual content ("Virtual Content").

5.2. Virtual Content has no real-world monetary value, is not money, electronic money or a financial instrument, and cannot be exchanged back for money or any other consideration (no cash-out).

5.3. The Player does not own Virtual Content. They only receive a limited, revocable, non-exclusive and non-transferable licence to use it in the game under these terms.

5.4. Virtual Content may only be transferred through tools the game itself offers (e.g. the in-game market). Any sale, purchase or exchange of Virtual Content or accounts outside the game for real money or other consideration (RMT) is prohibited.

5.5. The Operator may change, reprice, rebalance or remove Virtual Content (see 3.4), correct balances caused by errors, abuse or fraud, and remove Virtual Content obtained in breach of these terms.

5.6. Unused Virtual Content ends when the account ends or the Service is discontinued, unless the law provides otherwise (see 11.4).

6. Purchases, subscriptions and refunds

For legal review. Paid purchases are not yet available; this section applies once they launch. Withdrawal rules for consumers cannot be narrowed by contract below the legal minimum, so this text is as strict as the law allows. [TO ADD: payment provider, currency, taxes, invoicing, auto-renewal yes / no]

6.1. The following can be bought for real money in the Service, in particular:

  • one-off digital content: premium currency (e.g. Quantium), virtual items, skins, bundles ("Digital Content"),
  • time-based services: VIP, premium time and other subscriptions for a fixed period or with renewal ("Subscription").

Prices include VAT unless stated otherwise. The contract is concluded when the order is confirmed and payment succeeds; a confirmation is sent to the account e-mail.

6.2. Digital Content (one-off purchases) is non-refundable. Digital Content is supplied immediately after payment. Before completing a purchase, the Player expressly agrees to supply before the 14-day withdrawal period expires and acknowledges that they thereby lose the right of withdrawal (section 1837(l) of the Czech Civil Code, Act No. 89/2012 Coll.; Article 16(m) of Directive 2011/83/EU). After supply, the contract cannot be withdrawn from and no refund is given.

6.3. Subscriptions (VIP, premium time) are non-refundable to the extent permitted by law:

a) A Subscription is a digital service. It starts immediately after payment only at the Player's express request, which the Player confirms at checkout together with the information on the right of withdrawal.

b) A consumer may withdraw from a Subscription contract within 14 days of concluding it. Because they expressly requested the service to start, they pay a proportionate amount for the period the Subscription ran until withdrawal (section 1834 of the Czech Civil Code; Article 14(3) of Directive 2011/83/EU); only the remainder is refunded. If the Subscription was fully provided within that period with the Player's consent and acknowledgement, the right of withdrawal ends (section 1837(a) of the Czech Civil Code).

c) After the 14-day period, Subscriptions are not refunded, including any unused remaining time.

d) Cancelling a Subscription (turning off renewal) only stops future renewals. The paid period runs to its end and its unused part is not refunded.

e) Premium currency or items included in a Subscription are treated as Digital Content under 6.2.

6.4. Bans for breaching the rules: If an account is temporarily or permanently banned, or the contract is terminated, for breaching these terms or the Community rules, no refund is given for Digital Content or unused Subscription time, unless the law provides otherwise.

6.5. A chargeback or other misuse of payment methods without first contacting the Operator entitles the Operator to suspend the account until resolved and to remove Virtual Content and Subscriptions obtained from the payment concerned. This does not affect the consumer's rights towards their bank.

6.6. Statutory rights remain. Nothing in this section limits a consumer's rights from defective performance (sections 2389a et seq. of the Czech Civil Code) or other rights that cannot be excluded by contract. If paid content or a Subscription was not credited, was credited incorrectly or does not work, the Operator will remedy it after a report to [E-MAIL] by delivering it, extending it or refunding the payment, without undue delay and within 30 days at the latest.

6.7. Purchases by minors without a guardian's consent are handled individually at the guardian's request.

6.8. Requirements for the purchase flow (for the operator)

Internal requirement, for legal review. Without these steps the exclusion or reduction of withdrawal does not apply: the consumer could withdraw within 14 days without paying, and if the information is missing the period is extended by up to 12 months (section 1829(2) of the Czech Civil Code).
  • Before payment, the purchase screen must show the price, the Subscription's duration and renewal, and a link to these terms.
  • Digital Content: a mandatory, unticked checkbox: "I agree to immediate supply of the digital content and acknowledge that I thereby lose my right to withdraw within 14 days."
  • Subscription: a mandatory, unticked checkbox: "I request the service to start immediately and acknowledge that if I withdraw within 14 days I pay a proportionate amount for the period already provided, and that the right of withdrawal ends once the service has been fully provided." Plus information on withdrawal and the model withdrawal form.
  • A payment button labelled "Order with obligation to pay" or similar (section 1826a of the Czech Civil Code).
  • After purchase, a confirmation e-mail (durable medium) summarising the order, confirming the consents and acknowledgements given, with a link to these terms.
  • Keep a record of the consent (time, text version, account) as evidence.

7. Prohibited conduct and fair play

7.1. The Player follows the Community rules. In particular, it is prohibited to:

  • use cheats, bots, macros, automation, modified clients, or tools that read or modify memory or network traffic,
  • exploit bugs instead of reporting them,
  • circumvent the Service's protection, interfere with, overload or attack the servers,
  • trade Virtual Content or accounts for real money (RMT), share accounts, boost,
  • defraud other players, impersonate the Operator or its team,
  • harass, insult, threaten, spread hate, spam, or post illegal or sexual content.

7.2. Anti-fraud protection: The Service analyses game behaviour (e.g. command regularity, reaction times, results) and uses decoys invisible to normal players to detect bots and cheats. Details in the Privacy policy.

7.3. Sanctions: For breaches the Operator may, depending on severity, warn, mute chat, temporarily or permanently ban the account, remove Virtual Content, reset progress or terminate the contract. When an account is banned or terminated for breaching these terms, no compensation is given for Virtual Content or Purchases, unless the law provides otherwise. The Player may appeal a sanction at [E-MAIL]; the Operator reviews it and replies.

8. Player content

8.1. Pilot names, clan names and tags, chat messages, reports and other content the Player creates in the Service ("Player Content") must not break the law, infringe the rights of others or the Community rules.

8.2. The Player grants the Operator a free, non-exclusive, worldwide, perpetual and transferable licence to use Player Content within the Service and its promotion (e.g. showing a name on a leaderboard or a game screenshot), to modify and delete it.

8.3. The Operator does not pre-screen chat or Player Content but may remove illegal or inappropriate content and keep it as evidence. Illegal content can be reported in the game or at [E-MAIL] (Regulation (EU) 2022/2065, the Digital Services Act).

9. Intellectual property

9.1. The Service, the game and all of its content (code, graphics, 3D models, sounds, music, texts, names, the QUANT EIDOS logo) are protected by copyright and other rights of the Operator or its licensors.

9.2. The Player only receives the right to use the game under the EULA. Part of the content was created with the help of generative AI tools and further edited; sounds and music are partly from freely licensed libraries (Kenney and OpenGameArt under CC0, Mixkit). Third-party software (including Unity and PrimeTween) is used under its authors' licences.

9.3. The Player may share game screenshots and videos non-commercially (streams and videos with platform monetisation are allowed) as long as they do not suggest they are official Operator content.

10. Liability

10.1. To the extent permitted by law, the Operator is not liable for lost profit, indirect damage, loss of data or Virtual Content caused by outages, errors, a test-phase wipe, third-party interference or the Player's own conduct, nor for the content and conduct of other players.

10.2. The Operator's total liability to a Player is limited to the amount the Player paid the Operator in the last 12 months, but not less than [AMOUNT] CZK, unless the law does not permit a lower limit.

10.3. These limitations do not apply to damage caused intentionally or by gross negligence, to harm to natural rights of a person (life, health) or to other cases where the law prohibits limitation (section 2898 of the Czech Civil Code), and do not affect a consumer's rights from defective performance.

10.4. Indemnity: The Player compensates the Operator for damage and reasonable costs (including third-party claims) arising from the Player's breach of these terms or the law.

11. Term and termination

11.1. The contract is concluded for an indefinite period. The Player may end it at any time by deleting the account or by request to [E-MAIL].

11.2. The Operator may terminate the contract with immediate effect for a serious or repeated breach, otherwise with 30 days' notice.

11.3. Accounts inactive for more than [24] months may be deleted after prior notice by e-mail.

11.4. The Operator may discontinue the Service as a whole with at least [60] days' notice and will compensate consumers for unused paid content where the law requires it.

12. Changes to the terms

12.1. The Operator may reasonably change these terms (e.g. for a new feature, a change in law or security). Changes are announced by e-mail or in the Service at least 30 days before they take effect.

12.2. A Player who disagrees may terminate the contract before the change takes effect. Continued use after that date means acceptance.

13. Governing law, disputes and out-of-court resolution

13.1. These terms are governed by Czech law. This does not deprive a consumer of protection under the mandatory rules of their country of habitual residence.

13.2. Disputes are decided by the competent courts of the Czech Republic; a consumer may also sue in the courts of their domicile under Regulation (EU) No 1215/2012.

13.3. Out-of-court resolution of consumer disputes: the competent body is the Czech Trade Inspection Authority (Česká obchodní inspekce), Central Inspectorate, ADR Department, Štěpánská 15, 120 00 Prague 2, adr.coi.cz.

13.4. Compliance is supervised by the Czech Trade Inspection Authority (coi.cz) and, for personal data, by the Office for Personal Data Protection (uoou.gov.cz).

14. Final provisions

14.1. If any provision is invalid or unenforceable, the rest remains in force and the invalid provision is replaced by one closest to its purpose.

14.2. Failure by the Operator to exercise a right is not a waiver of it.

14.3. These terms are issued in Czech and English; the Czech version prevails in case of conflict.

14.4. Contact for questions, complaints and appeals: [E-MAIL], [POSTAL ADDRESS].
